July 2007 USFK Court Martial Results
|It is that time of the month again, USFK has released their monthly court martial results. It was actually a very slow month with only five court martial and four off post incidents handled in the Korean courts and none of them very serious. Just a lot of typical stupid stuff, but the two DUIs in the ROK court are bit of a concern because that makes six DUIs in four months for USFK. That is not a good trend.
Now these two servicemembers convicted in Korean court I just have to wonder what the heck they did:
In Incheon District Court on 10 July 2007, Major Brenda J. Suggars, HHC, EUSA, was
convicted of Trademark Law violations. Her adjudged sentence was a 1,000,000 Won
fine.In Incheon District Court on 10 July 2007, Sergeant First Class Malanie N. English,
524th MI, was convicted of Trademark Law violations. Her adjudged sentence was a
500,000 Won fine.
Trademark violations? Korea even enforces trademark laws? I wonder if they were selling off pirated DVDs and games? This is the first time I seen USFK servicemembers convicted for trademark violations so this is a new one on me. I have to wonder how often Koreans get arrested for trademark violations because all you have to do is take a stroll down to the Yongsan Electronics Market to see all the counterfeit goods being pedaled out in the open.

USFK Court-Martial Results for July 2007
At a special court-martial on 16 July 2007, Airman Basic Christopher R. Neal, 51st
Communications Squadron, was convicted of larceny and identity theft. His adjudged
sentence was forfeiture of $867.00 pay per month for 12 months, confinement for 12
months, and a bad-conduct discharge.
At a general court-martial on 25 July 2007, Specialist William E. Baker, Company A, 1st
Battalion, 72d Armor, 2ID, was convicted of dereliction of duty, maltreatment, and
assault consummated by a battery. He was found not guilty of aggravated assault. His
adjudged sentence was reduction to E-2 and hard labor without confinement for three
months.
At a general court-martial on 25 July 2007, Staff Sergeant James S. Tucker, Company
A, 1st Battalion, 72d Armor, 2ID, was convicted of assault consummated by a battery
and communicating a threat. His adjudged sentence was reduction to E-1 and
confinement for six months.
At a general court-martial on 26 July 2007, Staff Sergeant Shane R. Martin, HHC, 2d
CAB, 2ID, was convicted of conspiracy, larceny, solicitation, obstruction of justice, and
false official statement. His adjudged sentence was reduction to E-1, confinement for
one year, and a bad-conduct discharge.
At a general court-martial on 31 July 2007, Sergeant Donyea L. Foster, 275th Sig Co,
41st Sig Bn, 1st Sig Bde, was convicted of willfully disobeying a superior commissioned
officer and of being drunk and disorderly. He was found not guilty of violating a general
regulation, rape, assault, and an indecent act. His adjudged sentence was reduction to
E-4, forfeiture of $989.00 pay per month for three months, restriction for 60 days, and
three months hard labor without confinement.
Results of ROK Criminal Prosecutions for July 2007
In Daegu District Court on 2 July 2007, Staff Sergeant Arthur C. Shoenke, 293d Signal
Company, was convicted of DUI. His adjudged sentence was a 2,000,000 Won fine.
In Seoul Central District Court on 6 July 2007, Staff Sergeant (name removed by request), HHC,
EUSA, was convicted of DUI. His adjudged sentence was a 1,500,000 Won fine.
In Incheon District Court on 10 July 2007, Major Brenda J. Suggars, HHC, EUSA, was
convicted of Trademark Law violations. Her adjudged sentence was a 1,000,000 Won
fine.

There are a lot of NCO's who drive around drunk routinely. I'm glad there's finally some semblance of a crackdown.
A female Major and a female SFC? Humm, I guess the "sugar and spice and everything nice" theory is a bust! Nice to see PC taking effect at last.
In the past I have seen "Trademark Violations" mean they were coming through Incheon, often after an MWR trip to China or Thailand and were carryng too many necklaces or bags or the like. The customs guys usually are good about it unless you cop an attitude. I have seen an entire MWR group detained for a more thorough search due to the arrogance of one member who mouths off to an official.

You are probably right. Hopefully USFK issues some kind of statement about what happened just to warn others to avoid such things from happening again.
Could be that they were trying to mail massive amounts of knockoff items back to the states..but I think it's usually the military that nabs you for that.
The jurisdiction was in Inchoen District Court which may means that they were caught by the aiport custom officials when try to enter the country from shopping trip somewhere. And usually the women rather than the men who usually try to go after cheap brand name Knock off than men would. But still a Major and Senior NCO getting caught for violating customs law? They are both mid career professionals and they should have known better not to violate the host country's law.

Do you have the permission of the PAO, Provost Marshal and the USFK JAG to post these offenders names? Though they might have published these blotters, using there names under the privacy act is against the law.
These blotters are open source because they are published on the USFK website every month:

If USFK doesn't want people to read the blotters then they shouldn't publish it on their website. Plus many of this cases are published in the Stars & Stripes newspaper and even they have been publishing the court martial results in the newspaper when it is released on the USFK website.
