President Moon Remains Silent About His Administration’s Attempt to Oust the Prosecutor General

The Moon administration wants everyone to believe that the President did not know anything about the Justice Ministers attempt to oust the Prosecutor General for daring to investigate Blue House corruption:

Moon’s silence is widely seen as supporting Choo’s handling of the conflict with the top prosecutor, who, according to the minister, has not only committed various misdeeds but also violated the political neutrality required of a senior civil servant. Yoon, who has recently emerged as a favorite in polls for potential presidential candidates, has expressed, albeit tacitly, that he would consider a life in politics after his term ends in July next year.

The opposition parties are expressing their anger at the move by Choo, accusing Moon of trying to oust Yoon because he had initiated investigations into corruption allegations involving presidential aides. “The President himself should speak about the lawlessness of the justice minister,” Rep. Joo Ho-young, floor leader of the main opposition People Power Party (PPP), said in a statement. 

Joo criticized the President for being a coward. “If the President is discontent with the prosecutor general, he should take on the political responsibility and dismiss Yoon. The suspension of the prosecutor is a very regrettable moment in our legal history. The entire administration has been mobilized to oust the prosecutor general for baseless reasons.”

Justice Minister Suspends Korea’s Prosecutor General; Is It Because He Has Become too Popular?

Since Yoon Seok-youl topped polls as the preferred next President of Korea, the Korean left has gone into overdrive to destroy him:

Justice Minister Choo Mi-ae on Tuesday suspended Prosecutor General Yoon Seok-youl from his duty, in an unprecedented move amid a feud over prosecution reforms and various investigations involving Yoon’s aide and family members.

“The ministry has been investigating various allegations against the top prosecutor and found out some serious misconduct,” the justice minister said during a briefing.

As reasons to bar him from his duty and seek disciplinary actions, the minister cited what she called an “improper” meeting with media executives, the inspection of judges involved in controversial cases and interference with the prosecution’s investigations to protect people close to him. Also she said Yoon had impeded the ministry’s lawful probe by not responding to recent written investigation inquiries. 

“As the justice minister, who has the utmost authority to oversee the prosecution, I decided that it is not tolerable to let him continue his duty,” Choo said.

Shortly after the surprise announcement, Yoon called it “unfair” and said he would take legal action.

You can read more at the link, but everyone should not forget that Yoon was appointed by President Moon and has had a falling out with the administration because he would not stop the investigations into Blue House corruption.

Ever since then they have been trying everything they can to get him to resign since he is the only person standing in the way of the Blue House completely taking over the prosecution and thus protecting their political allies.

This response from the leader of the ruling Democratic Party shows that is exactly what this is:

Following the announcement, Rep. Lee Nak-yon, the chief of the ruling Democratic Party, said he was “shocked and disappointed” by the allegations raised against the top prosecutor. Lee urged Yoon to decide his position, apparently pressuring him to step down.

This is the tried and true tactic of throwing allegations at someone and then using the media to trash him in hopes it is enough pressure to get him to resign. We will see if this works with Yoon or not.

President Moon Orders Investigation of State Agencies Involved In Investment Fraud

Another week and yet another case of Blue House corruption:

President Moon Jae-in on Friday ordered the ministries to investigate their affiliated agencies’ decision making that led many of them to make dubious investments in a private equity fund suspected of large-scale fraud.    

“Moon ordered the government ministries to conduct thorough investigations into the state-run institutions’ investments [in the Optimus Asset Management], separately from the ongoing probe by the prosecution,” said Kang Min-seok, spokesman of the Blue House.    

Moon gave the order following media reports on state-run institutions, including the Korea Communications Agency, making massive investments in Optimus products.    (……….)

It’s the second time Moon commented on the Optimus scandal. After media reports detailed a link between a former presidential aide and the Optimus scandal, suspicions emerged that the company had lobbied top politicians and officials to avoid an investigation. Moon responded Wednesday that the Blue House must cooperate with the prosecution’s investigation.    
   
Reports were also made that Interior Minister Chin Young was an investor at Optimus. According to the Ministry of Interior and Safety, Chin, his wife and son invested a total of 500 million won in Optimus funds in February.

No Pardons Expected for Ex-Korean Presidents Park and Lee

It looks like ex-Presidents Lee Myung-bak and Park Geun-hye will continue to rot in jail for at least another year:

President Moon Jae-in is unlikely to grant Christmas pardons to his predecessors Park Geun-hye and Lee Myung-bak, a Blue House source told the JoongAng Ilbo Monday.    
   
“There will be no pardon for politicians, including former presidents,” the source, a high-ranking Blue House official, told the JoongAng Ilbo on condition of anonymity.    
   
The official cited public opinion, which is against pardons for former presidents.  
   
The source added that the idea is unpopular not only with the general public and the ruling Democratic Party, which was the opposition during the administrations of former presidents Lee and Park – both jailed for corruption – but even with the main opposition People Power Party (PPP), which worries that a pardon for either could be deadly for its chances in the March presidential election.

Moon Administration Wants to Establish New Agency to Investigate Major Crimes

Here is the latest attempt by the Moon administration to reduce the power of prosecutors in South Korea:

 Prosecutor General Yoon Seok-yeol strongly criticized a recent move by the ruling party to create another state investigative agency to limit the power of the prosecution service.

“Taking investigative power away from the prosecution amounts to regression of democracy and destruction of the spirits of the Constitution,” the top prosecutor said in an interview with Kookmin Daily published Tuesday.

“I am willing to stake my position for the 100th time if I could stop it,” he said.

The ruling Democratic Party (DP) is seeking to establish yet another agency tasked with investigating six types of serious crimes, including abuse of power and corruption, under the Ministry of Justice, which will strip the prosecution service of investigative power into those crimes and leave it only with the power to prosecute.

You can read more at the link, but this issue really comes down to is who would control this new investigating agency? If it is controlled by the Blue House with the potential to be used to settle political scores then I can understand the concern of setting up this new agency.

DPK Chair Proposes Pardoning former Korean Presidents Park Geun-hye Lee Myung-bak

It looks like the ruling party realizes that the end of the Moon administration is nearing which means the potential of the conservatives winning the next election. If that was to happen no doubt the conservatives would look to start locking up their liberal political adversaries just like the Moon administration has done to them:

Ruling Democratic Party of Korea (DPK) Chairman Lee Nak-yon is seeking to propose pardons for former presidents Lee Myung-bak and Park Geun-hye, who have been behind bars on corruption charges, to President Moon Jae-in.

“I will propose pardons for the two former presidents to President Moon Jae-in at an appropriate time,” Lee said during a New Year interview with local news agency Yonhap. Lee said the pardons of the two former presidents could be a way to promote reconciliation and overcome the ideological gap between conservatives and liberals.

“This year is the de facto final year for President Moon to practice policies, and this matter (of pardoning the two former presidents) needs to be solved at a right time,” Lee said. “I am seeking to propose it (to President Moon) apart from pros and cons from the supporters of the ruling bloc. … The party will have to play a more active role from now on.”

As former President Lee was sentenced to 17 years by the Supreme Court last October while Park is still on trial, a special pardon and suspension of sentence will be sought for each case, if President Moon pardons the two former presidents.

Something that is important to remember is that this is about more than just Presidents Park and Lee being locked up, there has been numerous journalists and conservative commentators prosecuted and locked up as well for speaking out against the Moon administration.

Ruling Party Backs Down from Impeaching Prosecutor General

An impeachment of Yoon Seok-youl would have been a gift to Korean conservatives who could have argued that the Moon administration was trying to get rid of the prosecutor who was investigating their corruption:

The ruling Democratic Party (DP) on Saturday urged restraint in the ongoing feud with the state prosecution service, although a few in its ranks are calling for the impeachment of Prosecutor General Yoon Seok-youl.   
   
Last Thursday, the Seoul Administrative Court reversed President Moon Jae-in’s two-month suspension of Yoon, leaving the DP divided about the next steps in the administration’s drive to tame the prosecution service.  
   
Some hardliners in the party, like Rep. Kim Doo-gwan, argued the DP should wield its large majority in the legislature to impeach Yoon — an action unprecedented in Korean political history that would inevitably generate a constitutional standoff.  
   
But cooler heads apparently prevailed, with DP Spokesman Huh Young on Saturday calling on members to “control” their emotions and refrain from positions that could further alienate the party from a public increasingly repelled by the administration’s war against Yoon.  
   
Impeachment proceedings against Yoon “could lead to a rejection by the Constitutional Court,” Huh wrote — in other words, they could fail spectacularly. He added the party should avoid action that might backfire and focus, instead, on building a stronger legal basis for prosecutorial reform.  
   
Yet the factor most instrumental in tempering the party’s antagonism towards the top prosecutor was a public statement from the president himself on Friday.

Prime Minister Says Both Justice Minister and Prosecutor General Should Resign

Now the Korean left appears to be willing to throw Justice Minister Choo Mi-ae under the bus in order to get rid of Yoon Seok-youl:

With the Choo-Yoon conflicts becoming a political burden on the administration, Prime Minister Chung Sye-kyun, during a meeting with the President, Monday, reportedly said Yoon’s voluntary resignation may be inevitable and also implied Choo’s resignation may also be needed.

The following day Moon had a short, unscheduled meeting with Choo at Cheong Wa Dae.

It was speculated that Moon talked about a “joint resignation” of Choo and Yoon. But the ministry said Choo only reported the current situation to the President and there were no talks about resigning.

You can read more at the link, but Choo is just carrying out the Blue House’s orders to get rid of Yoon because he would not cover up corruption occurring in the Moon administration. This is the thanks she gets from her own party, be a sacrificial lamb in order to pressure Yoon to resign.

Court Allows South Korea’s Prosecutor General to Return to Work

The latest attempt to take out South Korea’s Prosecutor General by the Moon administration has failed for now, but you know they will continue to go after him with everything they got:

A Seoul court on Tuesday granted a preliminary injunction requested by Prosecutor General Yoon Seok-youl over his suspension, in the first legal decision in a monthslong feud between Justice Minister Choo Mi-ae and the top prosecutor.

The Seoul Administrative Court ruled that suspending Yoon from duty was tantamount to dismissing him, which damaged the prosecution’s core principles of neutrality and independence.

The injunction will remain in effect until 30 days after another court decision is made. Yoon has filed a separate lawsuit against his suspension, along with having sought a preliminary injunction. 

Soon after the court’s decision came out, Yoon arrived for work at the Supreme Prosecutors Office. 

“I will do my best to safeguard the spirits of the Constitution and rule of law,” he said before heading to his office for the first time in a week.

ROK Prosecutor General Delays Moon Administration Attempt to Exonerate Corrupt Former Prime Minister

The last person remaining that can delay the Korean left’s attempt to completely take over prosecuting powers is Prosecutor General Yoon Seok-youl. The Moon administration is trying to rehabilitate the image of former corrupt Prime Minister Han Myeong-sook by appointing a judge with deep ties to to disgraced former Justice Minister Cho Kuk to look into it. ROK Heads may remember that Cho is good friends with Moon, so it is likely anyone with ties to him will provide investigation results favorable to Han Myeong-sook. Yoon has been delaying the investigation much to the ire of the Korean left:

President Moon Jae-in on Monday urged his justice minister and the prosecutor general to stop fighting each other and cooperate to complete reform of the prosecution.    

“Last week, the Ministry of Justice and the prosecution each launched task-force teams to protect human rights during criminal procedures,” Moon said during his opening remarks at a Blue House policy meeting that included both top officials. “Since the two powerful organs willingly started the initiatives, they must cooperate with each other and prepare a bold reform measure to make the people feel actual changes.”    

Prosecutor General Yoon Seok-youl has been facing growing pressures from the ruling party to step down for his constant discord with Justice Minister Choo Mi-ae.

Moon stressed the importance of cooperation as the friction between Yoon and Choo reached a new peak last week amid disagreements over an ongoing investigation into the prosecutors’ handling of a 2010 corruption probe into former Prime Minister Han Myeong-sook.    

On May 29, Yoon reassigned the case to the human rights monitoring office of the Seoul Central District Prosecutors’ Office. The investigation is reviewing prosecutors’ suspected coercion of a witness to testify against Han, and was originally assigned to the more independent and powerful Inspection Headquarters of the Supreme Prosecutors’ Office.    

Led by Han Dong-soo, a former judge appointed by Choo’s predecessor Cho Kuk, the Inspection Headquarters has the power to request warrants, conduct raids and detain suspects, unlike the human rights monitoring office. Han Dong-soo has also argued that his team should be in charge of the internal probe.    

During a National Assembly hearing last week, Choo said Yoon’s assignment was a mistake. She then ordered the Inspection Headquarters to directly question key witnesses instead of waiting for the human rights office’s findings.
