Should 36 Month Abortions be Illegal in South Korea? It Depends on How You Kill the Baby

This is so sickening and I can’t understand how any so-called doctor can conduct such procedures:

How late is too late to get an abortion? Could terminating a pregnancy at nine months be considered an abortion?

These questions have been under intense scrutiny in Korea after a woman in her 20s was recently found by police to have undergone a procedure at a clinic to end her pregnancy at 36 weeks.

After confirming the basic facts of the case, which first became public through a YouTube video of the woman in question, the police have named both her and the physician as criminal suspects and have launched an investigation.

However, following a 2019 Constitutional Court ruling that deemed the abortion ban unconstitutional, could they still be convicted for performing what was intended as an abortion?

Medical and legal experts contacted by The Korea Times said the doctor could be found guilty of murder ― but only if police find enough evidence showing that fetal termination was completed outside the woman’s body.

They said an abortion at such a late stage may have been performed with a labor induction method, which can be legally defined as a live birth and, therefore, a “murder after birth.”

This was the case in an incident that occurred in March 2019. A doctor was indicted on charges of killing a 34-week-old after putting the live baby in a bucket of water following an abortion procedure. He was eventually sentenced to three years and six months in prison. (…………..)

What could further complicate the case is the possibility that the physician might have used medications to induce fetal demise deliberately inside the woman’s body so as to avoid any legal troubles, experts said.

You can read more at the link, but an American leftist would probably call this doctor a hero and these women conducting late term abortions strong and empowered. Anyone that supports this is either evil or has a mental disorder.

U.S. Military Promotions Continue to Be Blocked Due to Abortion TDY Issue

This is a tough spot the Pentagon is in because is they relent on the paid TDY for abortions this will signal to every other Senator that they can get what they want by following this same playbook:

President Biden is sharply escalating his criticism of Alabama Sen. Tommy Tuberville, highlighting his blockade of military nominations and using him to criticize other right-wing Republicans he characterizes as extreme, obstructionist and willing to jeopardize the country’s national security.

Biden, who has often cited Republicans outside the congressional leadership as emblematic of what he calls their party’s radicalism, warned in harsher tones and with more specificity this week that Tuberville is undermining the servicemen and women who are putting their lives at risk.

“Something dangerous is happening,” Biden said Thursday night, speaking at the Truman Civil Rights Symposium. “The Republican Party used to always support the military, but today, they are undermining the military. The senior senator from Alabama, who claims to support our troops, is now blocking more than 300 military [nominations] with his extreme political agenda.”

For months, Tuberville has refused to let the Senate approve any senior military nominations by unanimous consent unless the Defense Department changes its policy of providing travel expenses for service women seeking an abortion. The policy is a backdoor way for the Pentagon to facilitate even late-term abortions, Tuberville argues, saying last week on the Senate floor that “anyone who calls themselves pro-life needs to stand up and be counted right now.”

Doctor In Korea Jailed for Killing Aborted 34-Week Old Baby who was “Crying”

This is a morbid story:

An obstetrician has been sentenced to three years and six months in prison for killing a baby who “burst out crying” during abortion procedures.

The Seoul Central District Court on Friday convicted the doctor, 65, surnamed Yun, of killing a 34-week-old baby and suspended Yun’s medical license for three years.

“Medical staff who participated in the operation have consistently said they heard the baby crying,” a three-judge panel of the court said in a statement. “It is clear that the doctor killed the baby, who was born alive.”

You can read more at the link, but this got me thinking what happens in a similar situation in the U.S. From FactCheck.org I found out that a similar situation in the U.S. would be prosecutable. However, what abortion doctors can do is deny medical care to keep the child alive:

A spokesman for Sasse told us the bill is aimed at “passive” situations in which there’s a “backing away” from providing medical interventions for a baby born alive. He cited the testimony of an OB-GYN doctor in the Gosnell case who said that if a baby were born alive as a result of an abortion procedure, the baby would “eventually pass.”

Korean Constitutional Court Rules that Abortion Ban is Unconstitutional

There has been talk for years about revising the abortion laws in South Korea and this court ruling gives the politicians the cover they need to do so now:

The Constitutional Court ruled Thursday that the country’s strict abortion ban is unconstitutional, a landmark decision that signals major change in various aspects of society. 
The nine-justice panel made the ruling in a 7-2 vote, in response to a 2017 complaint filed by an obstetrician standing trial for performing multiple abortions. A vote of two-thirds is required to reverse a ruling.
The court found that an outright ban on abortion under the criminal law is against the Constitution and ordered allowing termination in the early stages of pregnancy. 
Thursday’s ruling requires the parliament to revise the related laws by the end of next year.

South Korea to Conduct Review Anti-Abortion Laws

For those that didn’t know abortion is still illegal in South Korea, but the law is hardly ever enforced.  The Moon Jae-in administration is now going to conduct a review on whether to legalize the practice of abortion:

Cheong Wa Dae said Sunday it will review the legitimacy of the nation’s anti-abortion law.

Cho Kuk, the senior presidential secretary for civil affairs, said the government will begin the task by collecting more facts through research next year.

The announcement came after more than 230,000 people signed a petition against the law, which carries a sentence of up to one year or a maximum fine of 2 million won ($1,850) for a woman who has an abortion.

“The fetal right to live is critical, but the current law pushes abortions underground,” Cho said.“Besides, the law holds women accountable only, excluding men who are also responsible.”

“Based on the outcome of the research, we can take a step forward and begin a new debate.”

According to the government’s latest survey conducted in 2010, about 169,000 abortions were performed that year most of them (94 percent) were done illegally, but only about 10 people were indicted.  [Korea Times]

Thousands of Aborted Baby Pills Seized By Korean Authorities

I don’t know who is worse, the people making pills from aborted babies or those willing to purchase them?:

More than 8,500 pills made from baby flesh have been found over the past three years, a main opposition party lawmaker said Tuesday.

The pills, allegedly made from the flesh of aborted or stillborn babies, were mostly smuggled from China in the false belief they are good for health.

According to data obtained by Rep. Park Myung-jae of the main opposition Liberty Korea Party, 8,511 capsules were found from 2014 to June this year.

In 2014, 6,694 pills were found, 251 in 2015 and 476 last year.

Rep. Park said most of the pills were smuggled by international mail.  [Korea Times]
